1. Accounts & eligibility
You must provide accurate information and keep your credentials secure. Club administrators are responsible for the users they invite. Accounts for minors must be created or authorized by a parent, legal guardian, or the swimmer's club.
2. Acceptable use
You agree not to misuse the service, including by attempting unauthorized access, uploading unlawful content, interfering with others' use, or using the platform to violate any applicable law.
3. Payments, registration fees & platform fees
Registration and subscription payments are processed by Stripe. Clubs set their own registration fees and payment schedules; SwimSpark may charge a platform fee and/or subscription fee as agreed. You authorize the applicable charges, including scheduled installments. Refunds are handled according to [your club's and SwimSpark's refund policy].
4. Club content & data
Clubs and users retain ownership of the content they submit. You grant SwimSpark the rights needed to host and process that content to provide the service. Our handling of personal data is described in our Privacy Policy.
5. Service availability
We aim for high availability but the service is provided “as is” and may be updated, interrupted, or discontinued. We are not liable for losses arising from downtime or data unavailability except as required by law.
6. Disclaimers & limitation of liability
To the maximum extent permitted by law, SwimSpark disclaims implied warranties and our aggregate liability is limited to [amount / fees paid in the preceding 12 months]. This section does not limit liability that cannot be excluded under applicable law.
7. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these Terms or to protect the platform and its users.
8. Governing law & contact
These Terms are governed by the laws of [jurisdiction]. For questions about these Terms, contact [Company Legal Name] at [legal@example.com].
